These Terms of Service ("Terms") govern your access to and use of PropKeep at propkeep.ca (the "Service"), operated by PropKeep ("we", "us", or "our"). By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Related policies form part of these Terms: Privacy Policy, Cookie Policy, Acceptable Use Policy, Cancellation & Refund Policy, and Disclaimer.
1. Who we are
PropKeep is an online marketplace that connects property owners ("Owners") with independent local workers and service professionals ("Workers") for property care and related services (for example cleaning, lawn care, and similar jobs). We provide tooling for discovery, scheduling, messaging, reviews, and payment facilitation. We are not a party to the service contract between an Owner and a Worker for the physical work itself.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract under applicable law to use the Service. You are responsible for the accuracy of information you provide and for keeping your sign-in credentials secure. You must notify us promptly of unauthorized use of your account.
Accounts may sign in with supported identity providers (for example Google). Optional methods (email magic link, phone OTP, or other providers) appear only when configured. One account may use Owner mode and, after completing worker onboarding, Service (Worker) mode. Administrators may provision or restrict accounts as needed to operate the platform.
Owner accounts
Owners may add properties, set job prices and service details, post open jobs or request specific Workers, tip after completion, leave reviews, and open disputes. Owners must provide accurate property and access information and keep premises reasonably safe for Workers to perform booked work.
Worker accounts
Workers must complete onboarding (including accepting the worker contractor agreement), maintain an accurate profile and service area, and only claim or accept jobs they can perform. Workers are independent contractors — see Section 4.
3. The marketplace service
Job prices shown before booking are the Owner's offer for that visit. Platform service fees are disclosed in the app before you confirm. Payment authorization and capture timing are described in Section 5 and in the Cancellation & Refund Policy.
Open jobs may be claimed by eligible Workers or assigned by the platform according to marketplace rules (including time limits for response). Unclaimed or unanswered assignments may be released or expire so another Worker can take the job. We may change matching rules, categories, or features as we improve the Service.
Sensitive property details such as access codes, Wi‑Fi credentials, and emergency contacts are intended to be shown to the assigned Worker only after they accept the job. Owners remain responsible for what they share in messages or notes.
4. Worker contractor agreement
Workers on PropKeep are independent contractors, not employees, partners, or agents of PropKeep. Nothing in these Terms creates an employment relationship. By registering as a Worker (and whenever this agreement is updated), you agree that you will:
- Perform jobs you claim or accept to a professional, lawful standard.
- Honour the scheduled date and time. If you cannot, release the job in the app as early as possible (free more than 1 week before the job starts; 15% from 1 week to 48 hours; 25% from 48 to 24 hours; 50% within 24 hours). Fees may be withheld from your next payout as described in the Cancellation & Refund Policy.
- Respond to assigned jobs within the stated response window (typically 24 hours); unanswered assignments may be released.
- Keep Owner property details, access codes, Wi‑Fi credentials, and contact information confidential and use them only to perform the booked job.
- Accept that PropKeep retains a platform fee and that your expected pay is shown before you claim or accept a job.
- Supply your own tools and equipment unless the Owner expressly provides supplies for that job.
- Maintain any insurance, licences, or registrations required for your work, and comply with applicable laws and tax obligations (including reporting income).
- Not misrepresent your identity, skills, verification status, or availability.
You must accept this agreement in the app when you register as a Worker and again whenever we publish an updated version that requires re-acceptance.
5. Payments, fees, and tips
Unless the environment is running in simulated payment mode (no payment provider configured), Owners authorize payment when a booking is confirmed and are charged when the job is completed, subject to cancellation fees described in the Cancellation & Refund Policy.
PropKeep charges an Owner booking fee of 15% on a first completed visit with a given Worker, 10% on the next, and 5% on later visits with that same Worker (added on top of the job price). The fee for a visit is set when a Worker is confirmed and does not change afterwards. PropKeep also charges a 5% service fee to Workers (deducted from the job price). Workers receive 95% of the job price, plus any tip the Owner adds, less any Worker fees owed (late release or at-fault dispute) that we withhold from that payout. Optional priority-match or promo adjustments, if offered, are shown before you confirm. Payouts are sent to a Worker's connected payout account when payouts are enabled. Amounts still owed after one payout remain on the account until later payouts cover them.
Tips are optional, paid by the Owner after a job, and generally non-refundable except in cases of clear error or as determined through a dispute.
6. Cancellations, disputes, and reviews
Cancellation timing and fees are set out in the Cancellation & Refund Policy. A Worker who has accepted a job may release it before check-in; the job returns to Find Work with a complimentary Priority match. Owner cancellation fees are taken from the payment hold on that booking. Worker release fees and at-fault dispute fees are withheld from the Worker's next payout. Owners may open a dispute from a booking within the review window if work was not performed satisfactorily. We may request information from both parties and decide on refunds, reassignment, Worker fees, or other remedies in our reasonable discretion.
Reviews must be honest and based on a real booking. We may remove reviews that violate our Acceptable Use Policy.
7. Acceptable use and content
You must comply with the Acceptable Use Policy. You retain ownership of content you submit (property details, photos, messages, reviews) and grant PropKeep a worldwide, non-exclusive licence to host, display, and use that content as needed to operate and improve the Service. You represent that you have the rights to submit that content.
8. Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Service you acknowledge that processing of your personal information as described in that policy is necessary to operate the marketplace.
9. Third-party services
The Service may rely on third parties (for example identity providers, maps/geocoding, email, SMS, payments, hosting, or monitoring). Their terms and privacy practices apply to their services. We are not responsible for outages or acts of third parties beyond our reasonable control.
10. Disclaimers and limitation of liability
Please read the Disclaimer. To the fullest extent permitted by applicable law, PropKeep is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation, or any particular outcome of work performed by Workers. Nothing in these Terms excludes liability that cannot be excluded under applicable consumer protection or other mandatory law.
11. Suspension and termination
You may stop using the Service and request account deletion from your account settings, subject to our Privacy Policy and retention needs. We may suspend or terminate access for violations of these Terms or the Acceptable Use Policy, for risk or fraud concerns, or to comply with law. Outstanding payment or dispute obligations may survive termination.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will change when we do. Material changes that require Worker re-acceptance will be surfaced in the app. Continued use after an update constitutes acceptance of the revised Terms, except where re-acceptance is expressly required.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction, except where mandatory law provides otherwise.
